4. Prices and Payment
Prices are displayed in South African rand (ZAR), unless stated otherwise.
Any applicable taxes, delivery costs and additional charges will be disclosed before payment.
Online payments are processed securely using Yoco.
Goodbyes does not add a separate surcharge solely because a customer chooses an eligible Yoco card payment method.
Customers must provide accurate billing and transaction information.
Orders are subject to successful payment confirmation.
5. Bookings and Appointments
Recording appointments are subject to scheduling and availability.
Customers must provide accurate information required to arrange the session and must communicate any relevant accessibility or practical requirements.
Customers should inform us promptly if they need to reschedule or cancel.
Applicable cancellation and refund arrangements are set out in our Refund & Cancellation Policy.
6. Recording Consent
The customer purchasing a recording service must ensure that individuals participating in the recording have been informed about the nature and purpose of the recording.
Goodbyes may require participants to provide separate recording consent before a session proceeds.
Where a participant is a child or cannot independently provide legally valid consent, the necessary authorisation must be obtained.
Goodbyes reserves the right to postpone or decline a recording where required permissions or other lawful grounds have not been established.
Where agreed, chapter recordings may be transcribed using OpenAI and reviewed by the interviewer. Optional personal messages may be designated for the main production or for a separately consented sealed vault; choosing the vault does not authorise publication.
A sealed vault message is kept until authorised release or customer-requested deletion, separately from the ordinary 12-month recording and download period. No Home Affairs-backed verification provider is currently connected and vault release is disabled. Any future release requires an authoritative matching deceased-status result and administrator approval under separately agreed release arrangements.
7. Customer Content and Ownership
Customers and other relevant rights holders retain ownership of their pre-existing photographs, personal stories, recordings and other materials.
By supplying materials to Goodbyes, the person submitting them grants us a limited right to use, reproduce, edit, store and process those materials to the extent necessary to provide the agreed services.
The customer confirms that they possess the necessary rights or permissions for materials they submit.
Ownership of the final edited production and any applicable licences will be governed by the agreed service scope.
Unless expressly agreed otherwise, our internal production methods, software, templates and pre-existing creative assets remain our property or that of their respective owners.
8. Privacy and Confidentiality
We respect the personal and confidential nature of customer recordings.
We will process personal information in accordance with our Privacy Policy and applicable law.
Private customer recordings will not be used for public marketing purposes without appropriate permission.
Customers should understand that sharing a download link, file or access credential with others may allow those persons to access the relevant content.
9. Production and Creative Decisions
Where a service involves editing, sequencing or creative production, Goodbyes will endeavour to produce the agreed deliverables with reasonable care, skill and diligence.
Any included review rounds, revisions or changes to the production scope will be specified in the applicable product description or service agreement.
Requests outside the agreed scope may attract additional charges, which will be communicated for approval before the additional work proceeds.
10. Digital Delivery
Completed digital products will be delivered in the agreed format and through the delivery method communicated to the customer.
Published recording links, downloads and access are available for 12 months from the date of publishing.
After the initial 12 months, continued hosting is optional and will be quoted separately for a nominal fee.
Any limitations relating to supported file formats will be disclosed in the relevant service arrangements.
11. Physical Products
Where physical products are sold, applicable product descriptions, delivery costs and estimated fulfilment periods will be communicated before purchase.
Consumer rights concerning defective goods, returns and statutory remedies remain in effect.
12. Cancellations and Refunds
Cancellation requests and refunds are governed by our Refund & Cancellation Policy, subject to applicable statutory consumer rights.
13. Intellectual Property and Use of Deliverables
The Goodbyes website, branding, software and original business materials are protected by applicable intellectual property laws.
Customers may use their delivered recordings for the purposes permitted by the applicable service agreement.
Nothing in these Terms transfers rights belonging to third parties.
Goodbyes will not use a customer's private completed production for advertising, public distribution or unrelated commercial purposes without appropriate authorisation.
14. Website Availability
